By accessing or using AVFreelancer, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions. These terms govern your use of the platform, including account registration, project participation, communication, and all related services.
If you do not agree with any part of these Terms & Conditions, you should discontinue use of the AVFreelancer platform immediately.
AVFreelancer acts solely as a facilitator that connects independent freelancers and clients through an online platform. We provide technology, communication, and project discovery tools that enable users to find opportunities and collaborate directly.
AVFreelancer is not an employer, contractor, staffing agency, recruitment agency, consultant, partner, or service provider. All project agreements and commercial relationships exist directly between the client and the freelancer.
The platform does not supervise, manage, or direct the work performed by freelancers. AVFreelancer does not guarantee project availability, freelancer availability, project success, technical accuracy, or business outcomes.
Users are responsible for evaluating opportunities and entering into agreements at their own discretion.
Freelancers are independent professionals and are solely responsible for their qualifications, certifications, licenses, technical expertise, work quality, project execution, safety compliance, taxes, insurance, equipment, and professional conduct.
Freelancers must ensure that all information provided on their profile is accurate and that they perform services in accordance with applicable laws, industry standards, and client requirements.
Clients are responsible for verifying freelancer credentials, certifications, references, experience, and technical capabilities before awarding any project.
Clients must clearly define the project scope, deliverables, timelines, payment terms, access requirements, site conditions, and applicable safety procedures before work begins.
Both clients and freelancers agree to communicate professionally, comply with applicable laws and regulations, and respect workplace safety requirements, intellectual property rights, confidentiality obligations, and contractual commitments.
Any misuse of the platform, fraudulent behavior, harassment, or unlawful activity may result in account suspension or permanent removal.
All payments are made directly between the client and the freelancer. AVFreelancer does not collect, hold, process, escrow, or distribute payments on behalf of users.
Clients and freelancers are responsible for agreeing on payment amounts, milestones, invoices, GST/TDS obligations, taxes, payment methods, and settlement timelines before work begins.
AVFreelancer is not responsible for payment delays, non-payment, refund decisions, invoice disputes, tax deductions, financial recovery, or enforcement of payment obligations between users.
Any refund arrangement or payment adjustment must be negotiated directly between the client and the freelancer according to their mutual agreement.
Freelancers are responsible for their own taxes, GST, TDS, income reporting, insurance, and other financial obligations arising from projects obtained through AVFreelancer.
Clients are responsible for complying with all applicable tax, accounting, and statutory requirements related to payments made to freelancers.
AVFreelancer shall not be liable for work quality, project delays, technical errors, business losses, property damage, theft, data loss, service interruptions, project failure, or any direct, indirect, incidental, or consequential damages arising from the use of the platform.
Users acknowledge that all projects and commercial decisions are undertaken at their own risk.
AVFreelancer is not responsible for workplace accidents, injuries, safety violations, electrical incidents, site hazards, equipment damage, or occupational risks that may occur during project execution.
Compliance with PPE requirements, client SOPs, local laws, and workplace safety standards remains the responsibility of the client and the freelancer.
Any dispute relating to project scope, payments, quality of work, delays, deliverables, safety, or contractual obligations must be resolved directly between the freelancer and the client.
AVFreelancer is not obligated to mediate, arbitrate, investigate, or enforce agreements between users.
Users must provide accurate and truthful information when creating an account. Fake profiles, impersonation, fraudulent activity, spam, harassment, or misuse of the platform may result in temporary suspension or permanent removal of the account.
Users are responsible for maintaining the confidentiality of their account credentials and all activities performed under their account.
AVFreelancer reserves the right to modify, update, or replace these Terms & Conditions at any time without prior notice in order to reflect changes in our services, legal requirements, technology, or business operations.
Continued use of the platform after changes become effective constitutes acceptance of the revised Terms & Conditions.
These Terms & Conditions constitute the entire agreement governing the use of AVFreelancer. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
By using AVFreelancer, you agree to comply with all applicable laws, regulations, and professional standards while using the platform and engaging in any project or business relationship.
